I've been in dispute with fitness first for a while since my membership card stopped working. I need it to get into the gym, as it's the only way the staff know I'm a paid member without going through the hassle of phoning the office of the main branch every time then issueing me with a temp card every time. They kept promising to send out a new card, but never did.
After a while of paying for but not being able to use my membership I told them I'd give them until Easter to sort it out otherwise I'd consider that my one month notice and cancel my direct debit. This I did. There was still another 2 weeks before the next payment at this stage, so they had nearly 2 months payment for no service. Of course, I'd had no response from the branch or head office to any of my phone calls, letters or emails during this time, until they noticed the cancelled direct debit! Then they started insisting I paid them even more money. They didn't actually seem to think they were obliged to give me anything in return for this money, with the girl saying that was irrelevant!
I won in the end, didn't get the 2 months money back, but it's worth it to get them off my back. What stunned me most was the report in the paper the other day that the same gym refused to cancel the direct debit of some guy who had died, because he'd not given one months notice in writing. Duh.

that is so rediculous.and their are alot of companies out there doing that and they do it thinking No one will fight it or take it to the mat and give a hoot enough to follow through to court and win!

The newspaper story was probably just an oversight in the system that, in all probability, was not reported accurately.
The company had the responsibility to get you a working card, they failed. Though it does sound like you were able to use the membership.. it was just a hassle that you chose not to go through. That's for you to wear.,
The rest sounds like bureaucratic membership retention.
Glad you got out of the contract. despite the hassle.

I think this is a typical case of 'now we've got your money, we don't give a damn' which is so prevalent amongst far too many industries.
Poor or nonexistent training for staff and often branch management, and no skilled staff capable of putting right things which go wrong. This is culture among businesses run by accountants, who see only figures on a printout. They far too often have little or no knowledge of the business they are involved in and people are of no consequence.
That said, my Mrs has used quite a number of gyms and found that, almost without exception, the staff are more interested in strutting around displaying their physique like a bunch of peacocks, than doing the job. Perhaps this a problem inherent to the nature of this industry.

Call me a cynic, but if I was looking for common sense I'd try the library rather than the gym.

Having had conversations with the people at head office, I actually believe that the story about the dead guy's membership was true. Everything they (apparently) said to him (or rather, his representative), they actually said to me. Seems they have a script. Which doesn't allow for unusual circumstances.
Anyway, I feel much better now I've had my rant! Just have to start running outside now, which, to be honest, I prefer anyway.
